These terms and conditions are supplemental to our General Terms and Conditions and our Privacy Policy. Definitions contained in the General Terms and Conditions and which are used in this document (the ‘Supplemental Terms and Conditions’) have the same meaning unless the context particularly and expressly requires otherwise. In all other regards words shall have their ordinary meaning.

Use of the App.
By accessing this Service on each occasion, you agree and acknowledge the following:
(a) We offer you the Service in collaboration with our licensors. The Service is provided on an “as is” and “as available” basis. Except as required by law, we give no warranty or representation, express or implied, as to the quality and availability over the internet and accept no responsibility for any technical failure of the Service (including any warranties implied by law in respect of satisfactory quality, fitness for purpose or use of reasonable care and skill). We do not guarantee that the Service shall be accessible, secure, without disruption, delay or errors and do not warrant the quality of calls made through the Service.
(b) The Service is provided only in combination with our telephony product offers. You can only use the Service if you have concluded a valid and effective subscriber contract for a digital telephony package with Virgin Media. If you terminate such products, the Service will be terminated automatically.
(c) You shall use the Service only for purposes that are permitted by these Terms and Conditions, any applicable law or regulation, and shall not use the Service in any manner which promotes or encourages illegal activity
(d) You shall not access or attempt to access the Service by any means other than through the Virgin Media Phone App environment.
(e) You acknowledge that the Service is only accessible through smartphone or tablet devices which are technologically appropriate and compatible to display the Service and are connected to a continuous wireless broadband internet connection.
(f) If you use functionality which accesses information in order to work on your smartphone or tablet device, you consent to Virgin Media Phone App accessing your smartphone or tablet device and the information.

  • Terms of Use.
    By accepting these terms and conditions, you expressly agree:
    Not to use the Service in a manner that is prohibited by any law or regulation, or to use the Service to facilitate the violation of any law or regulation or to facilitate any threatening or offensive behaviour. In addition, we reserve the right to provide any communication to law enforcement agencies or any other appropriate authorities in response to any lawful request, subpoenas and/or court order.
    Not to use the Service in any manner that could damage, disable, overburden, or impair the Service, interfere or disrupt with any other party's use and enjoyment of it.
    Not to attempt to gain unauthorized access to any account, computer systems or networks associated with the Service or to otherwise interfere with or disrupt any accounts, computer systems or networks connected to the Service.
    Not to obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Service.
    Not to use access to the Service to obtain information necessary for customer to design, develop or update unauthorized software that customer uses or provides to others to use to access the Service. The software for this service is using an open source code by Sofia SIP stack (http://sofia-sip.sourceforge.net/ )
    Not to modify, adapt, translate or reverse engineer any part of the Service or re-format or frame any portion of the pages comprising the Service, save to the extent expressly permitted by these terms and conditions or as permitted by law.

    Personal use only.
    Each subscription is to be used for your own personal communication purposes only. The use of the subscription for commercial purposes, such as calling numbers specifically to generate income for customer or others by placing such calls, is not permitted. Unusual call patterns may be considered indicative of such use and may result in Virgin Media terminating your subscription and blocking your user account.

No reselling.
By using this Service, you agree not to resell, distribute, rent, lease or loan, the Service to any third party or make available to the public. You shall not charge others to use the Service either directly or indirectly.

Limitations of the service.
The Service will only use your primary telephone number. If you have more than 1 telephone number with Virgin Media, the Service will work only on one of those numbers. We will limit the number of devices that can be activated per customer account and used to access the Service. We shall be entitled to block access to the Service if you act contrary to this Policy. We also limit the number of concurrent outgoing calls made on SIP clients. For purpose of fraud, we may block certain types of calls from mobile application, i.e. paid service numbers, international mobile and landline numbers to certain destinations.

Maintenance.
Virgin Media, in its sole discretion, reserves the right to perform maintenance on, modify or add additional features and functions, or to provide programming fixes, updates and upgrades, to the Service which may require a temporary suspension or limitation on the use of the Service until the works have been completed and you hereby acknowledge and agree that the implementation of such maintenance or updates to the Service may affect the availability of the Service and that you will not be entitled to claim damages for such suspension or limitation of the Service.

Termination.
If you breach these terms and conditions in any way, Virgin Media may suspend and/or terminate your access to this Service.Virgin Media may remove or disable access to any part of the Service and impose limits on the use of or access to parts of the Service or suspend or discontinue with the Service at any time with or without notice to you.Upon receipt of notification of termination, all rights granted to you herein shall terminate and you must cease all use of the Service.

Privacy.
By using the Service you agree that Virgin Media Communications Ireland Limited may process your personal information and any personal information that you supply in accordance with the Data Protection Acts 1988 and 2003 and in accordance with our Privacy Policy.

Contacting You.
We may contact you if you have downloaded Virgin Media Phone App with service messages including where you have not used the downloaded Virgin Media Phone App. We may contact you from time to time with promotions relating to this Service. Will may do this by SMS, email, other messages on Virgin Media Phone App, phone or post. You may tell us at any time that you do not wish to receive marketing messages from us as set out in our Privacy Policy.

Content of communications.
We do not control, or have any knowledge of the content of any communication(s) spread by the use of the Service. The content of the communication is entirely the responsibility of the person from whom such content originated. You may therefore be exposed to content that is offensive, illegal, harmful to minors, indecent or otherwise objectionable and in this respect you agree that use of the Service is at your own risk.

Third Party Charges.
You acknowledge that:(i) When using this Service at a Wi-Fi hotspot, you may be charged for access to that Wi-Fi hotspot and you acknowledge that any such charges are governed in accordance with the terms and conditions you have agreed with the Wi-Fi hotspot provider.(ii) In addition when using this Service over 3G or 4G mobile networks data charges will be applied by your mobile network operator, any such charges are governed by the terms and conditions you have with your mobile network operator.

Emergency Calls.
While using this Service, an Emergency Operator answering a telephone call made by you will not have your physical location or address information. You must provide the Emergency Operator with this information as the Emergency Operator will not be able to dispatch help if not in receipt of your physical location or address information and the call is not completed, dropped or disconnected or if you are unable to speak.

Exclusion of liability.
To the maximum extent permitted by law, we exclude liability arising from or in connection with your use of this Service (irrespective of whether the possibility of such damages or losses arising has been notified to us or not) and we exclude liability for any damage or injury to users or their smartphone or tablet devices due to their use of this Service.

Change to our Virgin Media Phone App Terms and Conditions.
We may change these terms and conditions at any time by sending you an SMS message with details of the change or notifying you of a change when you next start the application or log onto our website. The new terms will be displayed onscreen and you will be required to read and accept them in order to continue with your use of this Service.
